Surrick felt Berg had no standing as a voter to challenge the fitness of a presidential candidate.

"You’d have thought this ruling could have been made months ago," says Jeff Schreiber over on America's Right.

Berg’s trying to fast-track his appeal, but his long shot just got a lot longer. Some commentators opine he will lose the appeal too.

It seems that it’s up to the individual states to demand proper proof of birth.

The New Party, formed by members of the Democratic Socialists for America and leaders of an offshoot of the Community Party USA, was an electoral alliance that worked alongside the Association of Community Organizations for Reform Now, or ACORN. The New Party's aim was to help elect politicians to office who espouse its policies. Among New Party members was linguist and radical activist Noam Chomsky. (...)

Obama's campaign has responded to the allegations, denying the presidential candidate was ever a member of the New Party (...)

Many of the New Party's founding members were Democratic Socialists for America leaders and members of Committees of Correspondence, a breakaway of the Communist Party USA. Obama attended several DSA events and meetings, including a DSA-sponsored town hall meeting Feb. 25, 1996, entitled "Employment and Survival in Urban America." He sought and received an endorsement from the DSA.

According to DSA documents, the New Party worked with ACORN to promote its candidates. ACORN, convicted in massive, nationwide voter fraud cases, has been a point of controversy for Obama over the presidential candidate's ties to the group. In 1995, the DSA's New Ground newsletter stated, "In Chicago, the New Party's biggest asset and biggest liability is ACORN. (...) >>>

The Obama camp's denial is flying in the face of this black on white evidence, which is honestly getting a little overwhelming. Two's a coincidence, three is a pattern, anything more than that warrants digging in. The 'self-controlled' media are reduced to nothing but an Abama propaganda tool. Among the endorsers of the Obama-Biden ticket is "Youth Unite and Fight." No, it ain't the boy scouts ... but the Philadelphia Club of the young communist league usa [sic]. And Glenn Beck has a new Obama National Anthem out. The audio is really very good, while the cartoon is getting better the more you watch it! For those with a really strong stomach there is "Kenyan Muslim School Children Singing the Praises of O".

He also said he will be making that tape available in the next few days. Legal writer Jeff Schreiber on America's Right is confirming the news: I know for a fact that Berg does indeed have tapes of this kind in his possession -- but as the parts I heard were in a language I did not understand [and he was in the process of having translated], I cannot attest for sure that the tapes contain what Berg contends.

This story on "The Corner" - involving Pamela Geller of Atlas Shrugs, who was first on to the false birth certificate (COLB) - has just broken the Yahoo Buzz barrier with 50 buzzez z: "Turning the Page from Campaign Finance Fraud . . . What is the deal with Obama's birth certificate and citizenship status?" [Andy McCarthy] The article offers this reason for not having followed it up earlier: "Admittedly, I've ignored this issue up until now on the theory that if there was anything here worth looking at, surely the Hillary and McCain campaigns would have raised it." Never assume someone else will do your job for you! - Campaigners, buzzz z up ...

This is the latest status update by Jeff Schreiber: "just got word that the decision will likely NOT be today after all. First, I was told it would be on Thursday or Friday. Then, I was told yesterday that it would be at the end of yesterday or this morning. Now, I'm being told not to hold my breath. Listen, it's understandable. No judge wants to be overturned, especially with something like this."

Freedoms Defense Funds today released a TV ad on Obama's campaigning for Kenyan Communist agitator Raila Odinga. In the post "The O Plot Thickens: Law Suits Like Kittens" we reported in detail how Raila came into power by signing a pact with the country's Muslim representatives, imposing sharia law and evoking cooperation with the GWOT - which was particularly outrageous in the light that Obama in 2006, as a member of the Senate, campaigned in Kenya for his cousin at the taxpayer's expense.

The post also contains a link to a PDF document stating that “Friends of Senator BO” are on the books for 66,000,000 Kenyan Shillings/US$1 million. In the post-election turmoil atrocities were committed against the Christian population. Investigator Stanley Kurtz, senior fellow at the Ethics and Public Policy Center, has published the latest findings on Obama's associations with ACORN on the site of National Review. Kurtz in "Something New Here - Radical? Check. Tied to ACORN? Check. Redistributionist? Check.":

"During his first campaign for the Illinois state senate in 1995-96, Barack Obama was a member of, and was endorsed by, the far-left New Party.

Obama’s New Party ties give the lie to his claim to be a post-partisan, post-ideological pragmatist.

Obama & DNC Admit All Allegations of Federal Court Lawsuit - Obama’s “Not” Qualified to be President

Obama Should Immediately Withdraw his Candidacy for President

In the press release Berg opines that by defaulting, Obama and DNC admit the candidate is not qualified to run and demands his immediate withdrawal.

By not responding to the Requests for Admissions, the following happened:

According to Rule 36 of the Federal Rules of Civil Procedure, a party upon whom requests for admissions have been served must respond, within 30 days, or else the matters in the requests will be automatically deemed conclusively admitted for purposes of the pending action.

According to Rule 36 of the FRCP, Obama admitted to everything that was in the Requests for Admissions, as did the DNC with their Request for Admissions. All because they didn't respond within the thirty (30) time frame allowed by law. Any problem with Rule 36 should be directed to your elected representatives in Washington so they can work on legislation to change the current FRCP rules.

The media propaganda machine keep on ignoring the facts. But here's a news flash: you can ignore reality, but you cannot ignore its consequences. That kite won't fly anymore once the Judge has ruled. The question is, when that will be.

Berg: "Our website obamacrimes.com now has 50.7 + million hits. We are urging all to spread the word of our website – and forward to your local newspapers, radio and TV stations. Berg again stressed his position regarding the urgency of this case as, “we” the people, are heading to a “Constitutional Crisis” if this case is not resolved forthwith."

Judah Benjamin on Texas Darling is quoting the expert opinion of Jeff Schreiber on America's Right. He upholds Phil Berg's claim on these grounds:

"A Candidate for the Office of POTUS has (...) no form of Privacy Protection in Regard to matters pertaining to Eligibility for that Office. (...) The mere assertion of such a Claim is in, and of, itself grounds for Supposition of Ineligibility. (...) This Motion teeters on the brink of an admission of guilt, in fact appears to be one, in and of itself. Berg (...) SPECIFICALLY asked for ten Legal Admissions or Refutations and these have not been forthcoming. Instead, Obama and the DNC filed for Dismissal and a Protective Order, in other words, SPECIFICALLY refused to supply any information whatsoever. Obviously, Berg has been planning this because if Judge Surrick grants these motions, and until specific Refutation with supporting evidence is granted, Obama is Legally Admitting Ineligibility and that he is not a US Citizen, of any sort. It is ONLY a Technicality, BUT a technicality of devastating proportions. The DNC is admitting that they are fully aware of this, Legally."

Nevertheless, today he's not optimistic: "every fiber of my being tells me that Berg's suit will be dismissed for lack of standing, I've nonetheless had this nagging, itching feeling in my gut that Judge Surrick may just surprise everyone and come down, at least partially, for Berg. The rumblings I've heard from three different people, while CERTAINLY NOT CONCLUSIVE, do slightly reinforce my nagging gut feeling."

Berg - of course - has stated he'll take it 'all the way' (donations welcome on Phil's site).

In the meantime the campaign team has let it be known that the candidate is continuing ... eh, suspending his campaign on Thursday to "visit his very sick grandmother in Hawaii."

Welcome home, Barry! A recent article in the Honolulu Advertiser regarding the case states that the Director of the Board of Health is being pressed to make the document (COLB) public, which she refuses to do on privacy considerations.

If he gets the COLB, how is he going to explain the false one?

One more interesting point raised by Philip Berg: why hasn't the DNC vetted their candidate properly? Word has it that they considered it unnecessary since he was already vetted to be a senator. Problem is, the rules are different. It stands to reason that someone applying for the position of POTUS would have to meet a stricter set of qualifications than a senator.

The O Plot Thickens: Law Suits Like Kittens

The situation around Philip Berg's pending law suit, demanding proof of Barack Obama's natural born citizenship - which is a precondition for the Presidency - is getting more outrageous by the day.

Think about it: the entire United States and at least half the world are up in arms about these historical elections; there's a global financial crisis on, prime national hero Colin Powell has just endorsed the nominee, millions donated to his campaign and millions more voted for his candidacy, and now we have one US Presidential hopeful who believes that if you ignore unpleasant situations, these will go away all by themselves. It figures: thought creates reality in Barack Obama's book: he's the quintessential Postmodernist, fed on a life-long diet of subjectivism: "If I die overnight, will the sun rise tomorrow?" "No, I fear not, Your Excellency, oh Heavenly Lord of Your Own Private Universe."

The candidate and Howard Dean refuse to clear up the matter of Obama's natural born citizenship, so we're headed for a constitutional crisis. Change! is about right. Here's the latest update on the 17th of October, an interview with Phil Berg on The Right Perspective:


There are at least two more law suits being filed, one of which in Washington. Many more Americans are considering taking legal action as well (see comments on Berg's website Obama Crimes).

Once you've recovered your breath from that one, feast your eyes on this jaw-dropper: footage from an ACORN meeting in January 2007 (hat tip: Expose Obama) in which the candidate, spreading favors around, pledges the association of community organizers, they will shape his Presidential agenda.

This does not only show the intimate nature of their alliance, in the face of Obama maintaining that the extent of their association was limited to ACORN getting the vote in when he ran against Hilary Clinton; it is also indicative of either false promises and election bribing, or - if true - a taste if things to come: community agitators ... eh organizers running the White House!

That over, we've got some pretty awful video material about the candidate's involvement in the post election violence in Kenya, orchestrated by Communist Germany raised cousin Raila Odinga. And guess what... he stood on an election platform, promising to ... "spread the wealth around."

World Net Daily in the latest despatch from Nairobi: "How Obama friend tried to give nation to Muslim minority - Read 3-page agreement that promised to Islamize Kenya, protect terrorists".

Read here and see there how Raila indulged in another clan habit, political opportunism. Raila came into power by signing a pact with the country's Muslim representatives, imposing sharia law and evoking cooperation with the GWOT - particularly outrageous in the light of the following.

In 2006, as a member of the Senate, Obama campaigned in Kenya for his cousin at the taxpayer's expense. Contained in following PDF document is a line that states “Friends of Senator BO” and the amount shown is 66,000,000 Kenyan Shillings, which equates to US$1 million. As a side note, Dick Morris Associates is listed providing the value (21,335,000 KES or US$344,000) of pro bono work for Raila Odinga: PDF-Consolidated Statement of Campaign Financial Activities.

The vid poses the rhetorical question, why Barack Obama supports a man like Raila Odinga. Who's to say - perhaps because it's all in the family, the African tribal relationship, or the warm beating bossom of the Communist International.

Despite the continued cover up the October Surprise and the campaign Stop the Obama Constitutional Crisis are going viral ... and, it's having kittens.

After the law suit filed by former Deputy Attorney General of Pennsylvania, Philip Berg - a life-long Democrat we might add - a second has been filed. Check this out and observe the word-wrought:

Is Democratic presidential candidate Barack Obama a natural born U.S. citizen. His critics and his foes have spent a good deal of time raising doubt and spreading rumors that he’s not. Today, Steve Marquis of Fall City filed a lawsuit in King County Superior Court directing Secretary of State Sam Reed to get the proof – or remove Obama’s name from ballots. As Berg points out - if guilty - Obama may have defrauded a nation of 300 million people, not to mention the more than 18 million voters who donated to his campaign (how the party nomination went is made plain in a film by Gigi Gaston, "We Will Not Be Silenced": part I, part II, part III, part IV). Berg may even start another law suit to get campaign donations back.

In the meantime a Clam Share user has posted a Jeff Rense Radio interview with Phil Berg: here are part I, part II, and part III. The Obama campaign and the MSM keep mum, except for the above two articles. Obama's main critics appear to be - not Republicans - but Democrats! (check out the PUMAs on Just Say No Deal.)

Citizen Wells reports that Jeff Rense has been the subject of o'bot attacks (Action Wire?) earlier this year. As the post shows, there's also the Larry Sinclair claim, from which we will stay away. But it is all out there for what it is worth, and the O brown shirt assaults are real (we've had a 24 hour lock down ourselves a few weeks ago).

Perhaps at this stage it is expedient to remind ourselves of this little gem which made it through the cracks of the hermetically sealed layer of teflon: "(...) every suspicion you have about MSM being in the tank for O is true. Apart from them being ideologically in the tank (and that goes for the Western world at large), there's also the very practical consideration of salary and job tenure. But even Obama fans and voters should realize that what is at stake is nothing less than the rule of law. The puppet masters are as yet safely hiding in the shades, but they are turning America, the symbol of liberty, into a banana republic!

Case in point is the attitude towards legal issues, i.e. the Dems local chairman in the footage dismissing the challenge as somehow illegitimate. That is not an ethical attitude for someone in his position.

A lawsuit has been filed with the Pennsylvania Eastern District Court requiring Mr. Obama to produce documents to prove he is constitutionally qualified to run for President. So far Mr. Obama has refused to produce the documents and is trying to fight the court order to produce the documents. Any American should be able to prove citizenship in less than a day. Why can't Mr. Obama?

Better proof that this is a personality cult - all about the man instead of the substance - could hardly be brought in evidence. Update: Based on comments and email, it is evidently necessary to point out that Berg may or may not be correct in the factual assertions claimed in this video and, more importantly, in his court filings. Determining the factual basis is the responsibility of the court, based on filings provided by both parties. I have no way of knowing whether Berg is a kook on this issue or not.

The important point is that the Obama campaign has not chosen to confront Berg's claims in a straightforward manner. That is a fact. Posting two different electronic images of an alleged birth certificate does not carry weight in court. Nor do the opinions of organizations like factcheck.org or snopes.com. The only version of a birth certificate that would matter is one submitted to court and attested to as valid, under penalty of perjury, and subject to forensic examination.

It may be the case that Berg is completely wrong. If so, the Obama campaign could have submitted documentation to the court quashing this case. Instead, it has chosen to engage in a legal strategy of delay. Why would they do this if Obama's documentation were in order? Why would they only provide electronic (so far as I know) copies to friendly sources? Perhaps someone can explain that satisfactorily, but I cannot. >>>
